PLEASE READ THROUGH THEM CAREFULLY before placing your order. By using this website and/or placing an order you agree to be bound by the Terms and Conditions set out below. If you have any queries relating to them, please e-mail our customer service team at the address included in the Contact Details shown below. We may change these Terms and Conditions from time to time without notice to you. Changes will apply to any subsequent orders received.
Please also read our Security & Privacy Policy regarding personal information provided by you.

ORDERING
All products are subject to availability. We will inform you as soon as possible when any product cannot be supplied. If your item is not in stock, you will be advised if and when the item is likely to become available. At this stage, you will be given the option to cancel your order or an alternative product may be offered.
Please follow the ordering process carefully. Remember that you will not be able to make any changes to your order once you have checked out, so please make sure that everything is correct before clicking the confirm button.
When you have submitted your online order and provided you have given us a valid e-mail address, you will receive a confirmatory e-mail to acknowledge receipt of your order. Our acceptance of your order and the conclusion of the contract will only occur when we despatch your goods and delivery has taken place.
We reserve the right to refuse an order. Non-acceptance of an order may, for example,
result from one of the following:
The product ordered being unavailable from stock
Our inability to obtain authorisation of payment
The identification of an error within the product information including price
or promotion
If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time.
We will take all reasonable care, in so far as it is within our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.
DELIVERY INFORMATION AND COSTS
Full ownership of the goods will transfer to the customer when they have been paid for in full and delivery has taken place.
For Mainland UK, our STANDARD DELIVERY service will be within 5 working days Monday to Friday. Orders received on a Friday will go out for delivery the following Monday. An EXPRESS DELIVERY service is also available for Mainland UK where every effort will be made to deliver your goods within 1 – 2 working days.
Deliveries to Northern Ireland, Eire, the Highlands and Islands, AB Post Codes, Isle of Man and the Channel Islands will take longer to arrive (usually 1/3 additional working days). The Express Delivery Service is not available to these destinations.
Please also allow an extra day when UK Bank holidays are involved.

Our couriers typically deliver Monday to Friday 8 am. to 6 pm. (Please note Saturday and Sunday are not classed as working days).
A signature is usually requested on delivery. If you are not in when our couriers first try to deliver and they cannot find a safe location to leave the package, they will leave a card, take your order back and then attempt to deliver one more time on the following working day. Please follow the instructions on the card left by the courier to arrange delivery.
We are unable to change a residential delivery address once the order has been despatched.
PRICE AND PAYMENT OPTIONS
All prices are inclusive of VAT (where applicable) and are correct at the time of entering the information on to the system. The total cost of the order is the price of the product ordered plus the delivery charge, where applicable. Delivery Costs are added to your order when you review your basket.
Customers outside mainland UK could also be liable for import duty, quotas, permits, product restrictions and other local requirements. You are advised to check the latest applicable local requirements before placing an order.
For Card Payments, we accept credit/debit cards from Visa, Visa Delta, Visa Electron, Maestro and Mastercard. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment then you will be notified of this immediately at the check-out stage.
In assessing your request for goods, we may use your information for the purposes of the prevention of fraud.
RIGHT TO CANCEL AND RETURNS
Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel any item(s) ordered (excluding personalised items) within 7 working days from the day after you receive your goods. Such cancellation should be given in writing by letter or by fax or by e-mail – a phone call is not sufficient. You have a statutory duty throughout the period of cancellation to retain possession of the goods and take reasonable care of them.
Any monies paid, including initial delivery costs for the order where applicable, will be refunded within 30 days of cancellation. Each item returned is refunded separately and credited to your original method of payment. This will appear on your statement as a refund/credit from “Rapidname Limited T/A MISH MASH”. If your card expires before we process your refund, please contact our sales desk on 01422 371311 with your order number, postcode and new card details. For security reasons we cannot accept this information by e-mail.
If you exercise your right to cancel, you must return the relevant item(s) in saleable condition with all original packaging and tickets as soon as practicable at your own cost. Please obtain a valid Returns Authorisation Number by e-mail or by telephoning our sales desk on 01422 371311 as Returns by post cannot be accepted without such a valid number. If returned by post, it is suggested that you remember to ask the Post Office for your proof of posting certificate and retain this for your reference. Without this, we cannot refund any money if we do not receive the returned item(s).
RETURNING GOODS BOUGHT AS A SPECIAL OFFER
If you return a single item bought as part of a multi-buy discount offer (for example “buy 2 for £20.00”) you will be refunded the full price of that item less the total discount given in the offer. If you return all items purchased with the multi-buy discount, you will be refunded with the full multi buy value.
REFUND OF THE DELIVERY CHARGE
If we have made a mistake on an item sent to you or it is faulty, damaged, of unsatisfactory quality or unfit for purpose, we will refund the delivery charges (where applicable) you have paid to receive that item unless it was sent to you with other items which you are not returning. We will also refund, on advice by you of the amount involved, the cost of the postage incurred by you when returning such goods to us.
STATUTORY RIGHTS
Your statutory rights are not affected by our returns policy.
PRODUCT INFORMATION
We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.
All sizes and measurements are approximate, however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes.
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

We continually update our online store. From time to time our local suppliers may run special local promotions (which may or may not be available on our website) or we may offer special discounts on line that are not available at our local suppliers. Some website promotions may not be available to customers in particular jurisdictions.
Mish Mash is not responsible for any inconvenience and/or damage resulting from the use of the website, including, but not restricted to, any interruptions in the availability of the website, the presence of computer viruses or external intrusions or, more generally, any case as defined as outside our control by UK and US law.

Our mission is to find the diamond in the rough – one Male, one Female – with the confidence and style to be the face of MISH MASH for our Spring/Summer 2010 Collections.
The winners will feature in our next photo shoot and will see themselves on our website, in stores and on other promotional material.
Entrants must be UK residents, be 18 or over and must read and accept our Terms & Conditions and Privacy Policy to be eligible.

To enter, you should, please, submit Two photographs of yourself . One must be a close up of your face and the second must be a full length photograph of your entire body (for fuller details, please see copyright and restrictions in relation to photographs section below).
All entrants must provide an e-mail address, postal address and postcode and telephone number and be readily contactable on the e-mail address used for entry.
Entries can be made between Friday 4th.December, 2009 and Friday 15th.January, 2010. We recommend submitting as soon as possible.
The winners will be notified personally by e-mail by Friday 22nd.January, 2010 at the latest and the winners must claim their prizes by Friday 29th.January, 2010. The winners names and county will be published on this website.
FREE PRIZE DRAW
In addition to the “Face of Mish Mash” Competition winners, all competition entrants will be automatically entered into a Free Prize Draw to win a MISH MASH outfit (both top and bottoms) one for a Male and one for a Female. All entries received up to the closing date of Friday 15th. January, 2010 will be entered into this draw. The winners will be notified by phone and e-mail by Friday 22nd.January, 2010 and their names and county will be published on this website.
In the event of unforeseen circumstances, the promoter reserves the right to award a similar alternative prize of equal or greater value. The prize is as stated and there is no cash substitute.
COPYRIGHT AND RESTRICTIONS IN RELATION TO PHOTOGRAPHS
Copyright
The entrant must own the copyright in the photographs which they submit. In general, this means that the entrant took the photographs.
By entering the competition, the entrant gives the promoter an unlimited, perpetual, royalty free, irrevocable, non exclusive licence to use the photographs for the purposes of this competition and for promoting Mish Mash products.
For example, this licence includes the right for the promoter to edit, crop, adapt, modify, copy, publish, distribute and sub-licence the photographs in any way whatsoever.
Further, by entering this competition, the entrant agrees that the promoter may use their images:
with other photographs, images, words or graphics; and/or
in the context of anything else relating to this competition and the promotion of Mish Mash products.
To the extent permitted by law, the entrant will be deemed to have waived their moral rights in the photographs. For example, the promoter does not have to credit the entrant as the photographer.
Content
Entrants are not permitted to send anything which:-
is defamatory, private, confidential, embarrassing, offensive, an infringement of any third party rights (e.g. someone else’s copyright or
trademark), obscene, pornographic, indecent, vulgar, hateful, threatening, harassing, false, unfair, illegal or misleading,
- may cause alarm, upset or distress, or
may damage or interfere with the promoter’s or another person’s computer
systems; or
is otherwise unlawful.
The Photographs
The photographs must have been taken within the last six months before they are sent as an entry in the competition. The entrant must be fully clothed. Whilst entrants may crop and enlarge photographs, they must not submit photographs which have been substantially altered. By entering into the competition, the entrant agrees that the promoter can meet with the entrant to check the photographs are an accurate representation of him or her.
DATA PROTECTION AND PRIVACY
The Winners’ Photographs
The promoter will use the winners’ picture, likeness, image, name and age and any other personal data submitted about the entrant in connection with this competition. This data will be deleted after the promotion of our Spring/Summer Collection has been completed, which is likely to be in mid 2010.
The entrants’ details
Information about all entrants will be stored and used for the future marketing of Mish Mash products. Please refer to our Security & Privacy Policy for further information.
WEBSITE AND PRIVACY POLICY
To the extent these Terms conflict with the promoter’s website terms and Security & Privacy Policy, these terms take precedence.
General
The entry instructions form part of the Terms. By entering, entrants agree to accept and be bound by the Terms. The promoter reserves the right to amend these Terms and Conditions at any point during the competition if circumstances make this unavoidable.
Any breach of these Terms will result in the forfeit of the entry.
The promoter accepts no responsibility for any technical issues, system or software failures encountered on HYPERLINK "http://www.mishmashjeans.com" www.mishmashjeans.com or during entry into the competition. We will try to ensure the standard of the site remains high but we cannot be held responsible for interruptions of service. The promoter reserves the right to suspend temporarily the operation of the site without notice in the case of system failure, maintenance or repair or for any other reason beyond its control. Entrants are responsible for all internet connection costs charged by their service provider. If the entrant does not pay the bill they should get permission from the person who does.
The Promoter’s decision is final and no correspondence will be entered into. The Winners may be required to take part in publicity accompanying or resulting from the competition. No compensation shall be awarded for such participation.
English law applies and the English Courts shall have exclusive jurisdiction over any proceedings in connection with this competition.
